The present terms and conditions of sale herein shall apply unless otherwise stated in a written agreement on PCS Elektronik d.o.o official headed documentation, to both export sales and sales made by PCS Elektronik d.o.o. These terms and conditions of sale override and exclude any other terms stipulated or incorporated or referred to by the Customer, whether in the Customer order or during any negotiations or any course of dealing established between PCS Elektronik d.o.o and the Customer, and constitute the entire understanding between PCS Elektronik d.o.o and the Customer for the sale of products or services.

Prices
PCS Elektronik d.o.o reserves the right to alter prices at any time without prior notice. All prices are in USD (US Dollars).

Delivery and Transit Delays
Wherever possible shipping/delivery is recorded or registered. The shipping/delivery time to most countries of the world is normally within 14 working days, however on some occasions this may be extended by a few days if the postal system or carrier has restrictions or additional delays beyond the control of PCS Elektronik d.o.o.

PCS Elektronik d.o.o will use reasonable endeavors to meet delivery estimates but cannot accept any liability whatsoever for failure to do so however arising. The dates quoted for shipping/delivery are estimates only and a failure by PCS Elektronik d.o.o to comply with them shall not be a breach of these terms and conditions of sale.

The goods shall be at the Customer's risk on receipt of shipment/delivery, or, if the Customer has requested that he has arranged the collection of goods, at his risk on collection by him or his appointed agent.

The Customer is required to inspect the goods on receipt and to notify PCS Elektronik d.o.o of any defects or complaints within 3 days.

General Descriptive Matter
Whilst every Endeavor is made to ensure accuracy, illustrations or other details contained in the PCS Elektronik d.o.o website or brochure or any price list or advertising material or otherwise communicated to the Customer are intended merely to present a general idea of the product and nothing contained in any of them shall form part of the terms and conditions of sale between PCS Elektronik d.o.o and the Customer.

Limitation of Liability
The Customer will be responsible for ensuring the fitness for purpose of the goods for the Customer’s application. PCS Elektronik d.o.o accepts no liability whatsoever or howsoever arising in respect of loss, damage or expense arising from errors in information or advice provided whether or not due to the negligence of PCS Elektronik d.o.o or that of its employees, agents or sub-contractors save for any loss or damage arising from personal injury.

PCS Elektronik d.o.o shall not be liable to the Customer by reason of any representation (unless fraudulent) for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of PCS Elektronik d.o.o, its employees or agents or otherwise) which arise out of or in connection with the goods or their use or resale by the Customer.

Intellectual Property and Information
PCS Elektronik d.o.o are trademarks of PCS Elektronik d.o.o. Internet domain name PCS Elektronik d.o.o.com is licensed or owned and controlled by REA Enterprises Inc. All materials on any web site server using an PCS Elektronik d.o.o controlled domain name, brochure, any price list or advertising material, including, but not limited to the images, logos, text, JavaScript, illustrations and designs may not be copied, reproduced, republished, uploaded, posted or distributed in any way, including by e-mail or other electronic means. Without the prior written consent of PCS Elektronik d.o.o, modification of the materials, use of the materials on any other web site or networked computer environment is a violation of the copyrights, trademarks and other proprietary rights and is prohibited.

PCS Elektronik d.o.o takes all reasonable steps in the course of business to ensure that any work commissioned does not infringe any patent, design, trademark, copyright or any other rights of third parties.

Force Majeure
PCS Elektronik d.o.o shall not be liable to the Customer or be deemed to be in breach of contract by reason of any delay in performing, or any failure to perform, any of the obligations in relation to the goods and services, if the delay or failure was due to any cause beyond the reasonable control of InterTech FM. Without prejudice to the generality of the foregoing, the following shall be regarded, but not limited to, as causes beyond the reasonable control of PCS Elektronik d.o.o:

    *

      act of God, explosion, flood, tempest, fire or accident;

# war or threat of war, sabotage, insurrection, civil disturbance or requisition;
# acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
# import and customs regulations, charges or seizures;
# strikes, lock-outs or other industrial actions or trade disputes by employees of the postal system, carriers or other third parties;
# difficulties in obtaining raw materials, labor, or parts;
# power failure or breakdown in machinery.


Law
Any sale transacted by the PCS Elektronik d.o.o, is governed solely by Illinois Law any and all parties agree to submit to the exclusive jurisdiction of the State Of Illinois and its courts.

Partial Ineffectiveness
If any term or provision of this agreement or the application thereof to any circumstances to be invalid or unenforceable, the remainder of this agreement, or the application thereof to any circumstances other than those to which is invalid or unenforceable, shall not be effected thereby and each terms and provisions of this agreement shall be valid and enforced to the fullest extent permitted by law.

Goods made by parties other than the PCS Elektronik d.o.o

Warranty Returns Policy
In the event of goods being returned the customer:

    *

      shall enclose with the returned goods a copy of either the order confirmation email, dispatch confirmation email or the sales invoice and a completed copy of the returns form;

# is under a duty to restore goods to PCS Elektronik d.o.o and to maintain them in the identical condition in which they were supplied by PCS Elektronik d.o.o;
# is responsible for the cost of returning any goods to PCS Elektronik d.o.o unless the goods prove to have a manufacturers fault. PCS Elektronik d.o.o can arrange for the collection of goods in the original packaging at the customer's expense. PCS Elektronik d.o.o strongly recommend that if the customer is returning goods by their own means, that the customer use adequate packing material and an insured courier service as PCS Elektronik d.o.o will not be held liable for any goods being returned that are lost or damaged in transit. The customer is responsible for the goods until they are signed for by a member of staff at the business premises of PCS Elektronik d.o.o. If goods are damaged or not saleable as new, PCS Elektronik d.o.o reserves the right to seek recompense.

Any goods returned that are not covered under the manufacturers warranty will be liable to inspection charges, parts, labors and delivery costs, these must be paid for in full before returning the goods to the customer. Goods repaired and not paid for in full within 30 days will be sold to cover any costs incurred by PCS Elektronik d.o.o.

Orders
All orders regardless of item must be paid in full prior to shipping this includes and encompasses all service, consulting, installation and custom orders. Upon receiving the Customer's order, the:

      Credit card is authorized, address checked and charged. Should the card decline the Customer will be informed and order will be placed on hold until payment is secured. Should the card payment be CHARGED BACK following the date the goods were delivered and signed for, the Customer hereby agrees in advance for the card to recharged for the goods delivered and signed for without further recourse;

      Payment by check, direct bank transfer, money order or any other type of transaction that requires clearing will need to be cleared in full. Should any of these methods of payment fail to clear and be returned to PCS Elektronik d.o.o unpaid, the Customer will be informed and the Customer's order will be placed on hold until payment is secured;

Shipping fees:
Shipping fees are determined by the shipped weight/box dimensions and shipping destination. We want your item to arrive promptly and safely. Packing material, shipping cartons/boxes and labor are not calculated in the final auction price, we do not charge overages on the actual shipping cost as determined by the carrier, however we do include a small fee to cover these ever increasing costs, this small fee provides worry free packaging as our professionals use first-quality materials to pack items with care.

Our preferred shipping carriers:
99% of the time we typically ship via FedEx "Home Delivery" this service provides 2 - 3 day service to most parts of the USA and at very low rates. We also ship USPS Priority Mail and UPS when box size/weight/dimensions permit. Remember FedEx and UPS will not ship to P.O. Boxes.

Shipping insurance:
We require insurance on most items with a winning bid over $100. Insurance will also be required on all electronic items. A signature will be required for items with a winning bid over $250. Any damage to the goods must be reported to the carrier in writing on the shipping receipt. Any discrepancy/damage discovered subsequent to delivery shall be reported to pcs-electronics.us within 24 hours of its receipt. Failure to notify us within this time frame can effect possible claims, you must contact us within 24 hours no exceptions.

Shipping dates:
Merchandise will ship 1 - 5 business days after payment confirmation. Actual shipping time will depend upon the item, for example a stock item such as a stereo encoder (component board) will usually ship the same or next day. An item such as a 300W Stereo FM Transmitter will usually take 3 - 5 days to ship due to burn-in/test period required. All Cyclone antenna's are built to order and ship within 5 days of order.

International shipping:

Combined shipping:
If we can combine items into a single box we will charge only for that box weight and size. We cannot offer discount when shipping multiple boxes. Shipping rates are determined at checkout by our automated system.

LOCAL PICK UP:

Forms of Payment:
Papal/Visa/MasterCard/Discover/AMEX/Money Orders/Wire Transfers/Certified Funds/Cashiers Check & Personal checks. When paying by any form of check allow 7 - 10 days for clearance.

Money back guarantee:
We do offer a money back guarantee if the item is DOA or does not operate within reasonable limitations to the manufacturers specification. If the item fails to operate as intended for a period of 7 days from receipt and fails due to a manufacturing defect pcs-electronics.us will at their sole discretion either, repair, replace the item or initiate a refund. If you decide to return the item due to a "change of heart" you will be liable for a re-stocking fee as described in our terms and conditions of sale, please review our terms and conditions.


Warranty:
Unless otherwise stated all new products will carry the manufactures full warranty. Refurbished/Demonstration merchandise will include the remainder of the manufacturers stated warranty (if any) this period will be disclosed in the items description. Used equipment that has been checked and verified by pcs-electronics.us will be guaranteed to work upon arrival except in those circumstances where the item may have suffered damage during shipping.

pcs-electronics.us extends to the original end user purchaser all original manufacturers’ warranties which are not transferable and all claims are to be made through your dealer or distributor as per indicated procedures.

All manufacturers’ warranties will be supported by pcs-electronics.us. to ensure precise and speedy service when possible.

pcs-electronics.us. shall not be liable for damages of whatsoever nature arising out in connection with the product or its use thereof.

pcs-electronics.us. warranty shall not include:
a) Cost of reshipment of the unit to pcs-electronics.us. for repair purposes.
b) Any unauthorized repairs/modifications
c) Repair of unit whose seal has been broken without PCS Electronics's authorization.
d) Incidental/consequential damages as a result of any defect.
e) Nominal non–incidental defects.
f) Free replacement of parts like vacuum tubes, amplifier tubes and cooling fans.
g) Free replacement of semiconductors ( transistors, mosfets and IC’s) which are not covered under any warranty.
h) Shipment costs or insurance of the unit or replacement units/parts from customer to pcs-electronics.us and back from pcs-electronics.us to customer.

Warranty shall commence as of the invoice/shipment date and for the period of the manufacturer’s warranty.

To claim your rights under this warranty:

A. Contact pcs-electronics.us. Describe the problem to see if we have an easy solution. We retain extensive knowledge and information on problems which may occur and usually can fix these over the telephone.

B. If it is determined that the unit needs to be returned to the factory, we will issue a repair return authorization and shipping instructions to you.

C. When you receive the return authorization, you can return the unit. Pack the unit(s) carefully for shipment. If possible, use the original packing materials and assume the shipping carton will be dropped several times during the transportation process. We recommend the use of FedEx or similar freight services and would discourage the use of the postal system. If equipment is received inadequately packed, there will be a charge for re-packing the equipment for re-shipment. The risk of loss is assumed by you (pcs-electronics.us. is not responsible for damage or loss) until the package is received at pcs-electronics.us. We advise you to take out insurance for the full replacement value of the unit. Ship the unit PREPAID to the address specified by pcs-electronics.us's service manager on the return authorization. DO NOT RETURN UNITS WITHOUT A RETURN AUTHORIZATION, AS THEY WILL NOT BE ACCEPTED. Be sure to enclose a written descriptive statement of the problem experienced and a copy of your original invoice establishing the starting date of the warranty. Please note in warranty returns where no fault is found, there will be a $100 service fee plus return freight.

No work on repairs can be started until full payment is received. Any units submitted for repair and not paid for 30 days after submission will become the property of pcs-electronics.us.

Warranty Returns Policy
The parts and any workmanship commissioned by PCS Elektronik d.o.o is guaranteed for a period of 12 months from the date of the sales invoice against defects, providing the goods:

    *

      in the case of kits, are constructed and soldered properly;

# are not subject to use that is beyond normal/reasonable wear and tear;
# are not powered with an unsuitable power supply, power source or battery;
# in the case of transmitters are not operated with an unsuitable antennas or RF loads that cause damage to the output transistors;
# are not damaged from excessive over heating due to inadequate ventilation;


Qualifying goods will be repaired or, at our option, replaced providing the goods are returned to us, carriage paid and suitably packaged within a 12 month period, together with a copy of the original sales invoice. To prevent import charges being made on returned goods from countries and territories outside the USA, 4 photocopies of the original PCS Elektronik d.o.o sale invoice should be attached to the outside of the packaging, together with the relevant completed customs documentation stating that the goods originated from the USA and are being returned for repair/replacement. Under no circumstances will any returned goods requiring payment of import charges be accepted by PCS Elektronik d.o.o.

Refunds/Returns/Replacement Policy
Please take care when ordering your goods.

We provide simple a simple return policy, no exceptions. You may return most new, unopened items sold and fulfilled by PCS Elektronik d.o.o within 7 days of delivery for a full refund unless they were incorrectly ordered in such cases you will be charged a 30% restocking fee. Antenna and special orders are non-returnable. Items that are opened or returned more than 7 days after delivery will receive a partial refund on the basis that they are returned in a new condition, any and all refurbishment costs will be your sole responsibility. Due to the nature of transmission equipment we do not warrant final transistors, power amps, mosfets or any part of the system that is connected to a dummy load or transmission line.

We will reply with full instructions on how to return the goods. We will provide paperwork for you if you need to send something to PCS Elektronik d.o.o. Goods sent to PCS Elektronik d.o.o without the correct paperwork will be refused and returned to the sender at the senders expense.

Damaged Items
In the event the goods are damaged in transit and you paid to have the goods insured we will send you instructions on how to file a claim with the carrier, if you decided not to insure the goods during shipping we cannot accept responsibility once the goods leave our premises. If the goods suffer damage due to your neglect or abuse we can offer a fast repair service, all charges and costs associated with repairs/service including shipping will be your responsibility. Contact us in advance of sending the product as we may need to supply you import paperwork if you are outside the USA. Failure to observe this procedure may result in your shipment being refused and returned to you at your expense.

Faulty Items
All products are extensively tested prior to shipment, however if you do receive a product that develops a fault we will replace the item or arrange a refund where necessary. Contact us in advance of sending the product as we may need to supply you import paperwork if you are outside the USA. Failure to observe this procedure may result in your shipment being refused and returned to you at your expense.

Licensing
Some of our products, particularly transmitters, require an operating license. It is an offence in some countries of the world to radiate electro magnetic waves at certain frequencies without a license. It is the Customer's responsibility to check relevant laws, regulations and directives regarding licensing and putting into service any goods commissioned by PCS Elektronik d.o.o. Several of our products are certified for use in the USA as per the rules and regulations provided by the FCC, some of our products are type verified for use in the USA as per rules and regulations provided by the FCC. It is your responsibility to ensure the items you purchase meet the regulatory standards and are fit for the intended purpose. When making a purchase from PCS Elektronik d.o.o the Customer agrees to defend, indemnify and hold harmless PCS Elektronik d.o.o, it's employees and agents, from and against any claims, actions or demands, including without limitation legal and accounting fees, alleging or resulting from the improper or unlawful use of goods commissioned by PCS Elektronik d.o.o.

Actual shipping time will depend upon the item, for example a stock item such as a stereo encoder (component board) will usually ship the same or next day. An item such as a 300W Stereo FM Transmitter will usually take 3 - 5 days to ship due to burn-in/test period required. All Cyclone antenna's are built to order and ship within 5 days of order.

If we can combine items into a single box we will charge only for that box weight and size. We cannot offer discount when shipping multiple boxes. Shipping rates are determined at checkout by our automated system.

Warranty:
Unless otherwise stated all new products will carry the manufactures full warranty. Refurbished/Demonstration merchandise will include the remainder of the manufacturers stated warranty (if any) this period will be disclosed in the items description. Used equipment that has been checked and verified by pcs-electronics.us will be guaranteed to work upon arrival except in those circumstances where the item may have suffered damage during shipping.

pcs-electronics.us extends to the original end user purchaser all original manufacturers’ warranties which are not transferable and all claims are to be made through your dealer or distributor as per indicated procedures.

All manufacturers’ warranties will be supported by pcs-electronics.us. to ensure precise and speedy service when possible.

pcs-electronics.us. shall not be liable for damages of whatsoever nature arising out in connection with the product or its use thereof.

pcs-electronics.us. warranty shall not include:
a) Cost of reshipment of the unit to pcs-electronics.us. for repair purposes.
b) Any unauthorized repairs/modifications
c) Repair of unit whose seal has been broken without PCS Electronics authorization.
d) Incidental/consequential damages as a result of any defect.
e) Nominal non–incidental defects.
f) Free replacement of parts like vacuum tubes, amplifier tubes and cooling fans.
g) Free replacement of semiconductors ( transistors, mosfets and IC’s) which are not covered under any warranty.
h) Shipment costs or insurance of the unit or replacement units/parts from customer to pcs-electronics.us and back from pcs-electronics.us to customer.

Warranty shall commence as of the invoice/shipment date and for the period of the manufacturer’s warranty.

To claim your rights under this warranty:

A. Contact pcs-electronics.us. Describe the problem to see if we have an easy solution. We retain extensive knowledge and information on problems which may occur and usually can fix these over the telephone.

B. If it is determined that the unit needs to be returned to the factory, we will issue a repair return authorization and shipping instructions to you.

C. When you receive the return authorization, you can return the unit. Pack the unit(s) carefully for shipment. If possible, use the original packing materials and assume the shipping carton will be dropped several times during the transportation process. We recommend the use of FedEx or similar freight services and would discourage the use of the postal system. If equipment is received inadequately packed, there will be a charge for re-packing the equipment for re-shipment. The risk of loss is assumed by you (pcs-electronics.us. is not responsible for damage or loss) until the package is received at pcs-electronics.us. We advise you to take out insurance for the full replacement value of the unit. Ship the unit PREPAID to the address specified by pcs-electronics.us's service manager on the return authorization. DO NOT RETURN UNITS WITHOUT A RETURN AUTHORIZATION, AS THEY WILL NOT BE ACCEPTED. Be sure to enclose a written descriptive statement of the problem experienced and a copy of your original invoice establishing the starting date of the warranty. Please note in warranty returns where no fault is found, there will be a $100 service fee plus return freight.

No work on repairs can be started until full payment is received. Any units submitted for repair and not paid for 30 days after submission will become the property of pcs-electronics.us.

Warranty Returns Policy
The parts and any workmanship commissioned by PCS Elektronik d.o.o is guaranteed for a period of 12 months from the date of the sales invoice against defects, providing the goods:

      in the case of kits, are constructed and soldered properly;

# are not subject to use that is beyond normal/reasonable wear and tear;
# are not powered with an unsuitable power supply, power source or battery;
# in the case of transmitters are not operated with an unsuitable antennas or RF loads that cause damage to the output transistors;
# are not damaged from excessive over heating due to inadequate ventilation;


Qualifying goods will be repaired or, at our option, replaced providing the goods are returned to us, carriage paid and suitably packaged within a 12 month period, together with a copy of the original sales invoice. To prevent import charges being made on returned goods from countries and territories outside the USA, 4 photocopies of the original PCS Elektronik d.o.o sale invoice should be attached to the outside of the packaging, together with the relevant completed customs documentation stating that the goods originated from the USA and are being returned for repair/replacement. Under no circumstances will any returned goods requiring payment of import charges be accepted by PCS Elektronik d.o.o.

Refunds/Returns/Replacement Policy
Please take care when ordering your goods.

We provide simple a simple return policy, no exceptions. You may return most new, unopened items sold and fulfilled by PCS Elektronik d.o.o within 7 days of delivery for a full refund unless they were incorrectly ordered in such cases you will be charged a 30% restocking fee. Antenna and special orders are non-returnable. Items that are opened or returned more than 7 days after delivery will receive a partial refund on the basis that they are returned in a new condition, any and all refurbishment costs will be your sole responsibility. Due to the nature of transmission equipment we do not warrant final transistors, power amps, mosfets or any part of the system that is connected to a dummy load or transmission line.

We will provide paperwork for you if you need to send something to PCS Elektronik d.o.o. Goods sent to PCS Elektronik d.o.o without the correct paperwork will be refused and returned to the sender at the senders expense.

Damaged Items
In the event the goods are damaged in transit and you paid to have the goods insured we will send you instructions on how to file a claim with the carrier, if you decided not to insure the goods during shipping we cannot accept responsibility once the goods leave our premises. If the goods suffer damage due to your neglect or abuse we can offer a fast repair service, all charges and costs associated with repairs/service including shipping will be your responsibility. Contact us in advance of sending the product as we may need to supply you import paperwork if you are outside the USA. Failure to observe this procedure may result in your shipment being refused and returned to you at your expense.

Faulty Items
All products are extensively tested prior to shipment, however if you do receive a product that develops a fault we will replace the item or arrange a refund where necessary. Contact us in advance of sending the product as we may need to supply you import paperwork if you are outside the USA. Failure to observe this procedure may result in your shipment being refused and returned to you at your expense.

Some of our products, particularly transmitters, require an operating license. It is an offence in some countries of the world to radiate electro magnetic waves at certain frequencies without a license. It is the Customer's responsibility to check relevant laws, regulations and directives regarding licensing and putting into service any goods commissioned by PCS Elektronik d.o.o. Several of our products are certified for use in the USA as per the rules and regulations provided by the FCC, some of our products are type verified for use in the USA as per rules and regulations provided by the FCC. It is your responsibility to ensure the items you purchase meet the regulatory standards and are fit for the intended purpose. When making a purchase from PCS Elektronik d.o.o the Customer agrees to defend, indemnify and hold harmless PCS Elektronik d.o.o, it's employees and agents, from and against any claims, actions or demands, including without limitation legal and accounting fees, alleging or resulting from the improper or unlawful use of goods commissioned by PCS Elektronik d.o.o.
